The government consultation on giving a new mandatory power for possession if there is anti-social behaviour by tenants has been updated after the riots.

Housing minister Grant Shapps has added a letter to the consultation, saying that the original proposal is being broadened.

He says that where social tenants or members of their family are found guilty of the sort of anti-social behaviour or criminality that has been seen in recent days, that will ‘categorically’ provide a ground for possession.

The new mandatory power for possession would be extended to private landlords, although the Government does not think that private landlords would often use it as they already have the Section 21 procedure.

(Perhaps ministers should read of Mr Schofield’s case, above.)

The letter can be found here.
