What impact will landmark case ruling have on future possession claims?

David Smith, renowned property litigation and housing lawyer, will host a masterclass on possession claims this Friday following a landmark case ruling. 

Smith, a partner at JMW Solicitors, will present a the free masterclass in partnership with Fixflo. 

Titled Important Updates to Possession Claims in the Private Rented Sector, the learning session will deep-dive into recent legal changes surrounding possession claims and their implications for current and future possession proceedings.

Under the spotlight will be the Court of Appeal's ruling in the case of Trecarrell House Limited v Rouncefield. Smith supported the landlord's claim during his tenure as policy director of the Residential Landlords Association. 

The case is expected to set precedent and finally put to bed the debate on a section 21 notice's validity when the tenant is provided with a gas safety certificate after they move in and before they are served a section 21 possession notice.

Ruling on the case is scheduled to be released on Thursday 18th June and attendees to Friday’s masterclass, which will be streamed live at 10am, will be one of the first to learn about the court’s decision and what the case law will be on future possession claims.

Other topics to be discussed are the new Pre-Action Protocol for private renting and the Coronavirus Act 2020. Attendees will have an opportunity to ask questions live.

    Mr Robert Jenrick why are you making all anti-LL laws, is it because you are too young for the job or is it that you haven't a clue where have you been all those years while we struggled to survive & build up a Business, you destroy it at a stroke just like Rishi Sunack or Boris Johnston who have made a complete mess of the economy, a law all to themselves, they personally won't have any money worries, unlike Landlords or Tenants. We do our best to work together and were doing so until your interference, still you insist on driving the wedge in further, we see our Tenants as our business.partners not the enemies you have gone out of your way to create.

    Why as a Landlord am I not allowed to hear what theses people are doing with MY money???

    It is not anybody's money.....And as a landlord who gives business to Lawyers AND to Letting Agents alike, who do they think they are allowed to talk about MY MONEY behind closed doors.

    And not even invite the people who supply the money THEY live on!!!!!!!!!

    Outrageous, uncaring and idiotic.

    For sure his poxy company is now off my list of suppliers, which is all lawyers really are. A mere supplier!
