Very badly written, not enough information provided. Did the landlord comply with council's regulations when he created the "illegal" flats? If he did, then what he was doing was enabling more people to have homes rather than just one family being able to have a home. The government and politicians keep on harping that we do not have enough properties yet they then penalise a landlord when he tries to help reduce some of that problem - totally insane! The council should have granted permission of the flats - sure they could charge a back amount for lost council tax, but to take the landlord to court and then for the courts to uphold the confiscation request is lunacy!!!
