I ran an estate agents from 1985 and began investing in property at the start of the 1988 housing Act. I had a scum bag partner with no talent and we split after a short time. I worked as a financial consultant for Legal and General but best was to start my eviction firm evicthem and the process experts. Andrew now runs evicthem and I run the process experts. We are passionate about helping the landlord get his property back. This is based on my own personal experience as to how bad a bad tenant lets face it a person can be. These skills are honed over many years and we revel in getting the possession order at a good price and in the large majority of cases without a hearing.

Rent is paid in return for a roof over your head. If the property depreciates will the tenant share the loss? Someone must be really bored to come up with this idea. When my mechanic sells up I want a piece of it.

One such case, when the district judge opened the file in January in Croydon County Court she gave a summary judgement to strike out the claim because the how to rent guide and EPC had not been served. Since they were, an application is made to set aside the order and have a hearing, but instead having agreed with the fact that they were served said it is still struck out because the deposit prescribed was not given within thirty days. The first a made up striking out and the second a serious technically incorrect order which shows a District Judge who is highly incompetent or thinks that we are. A second application is made to request that this Judge remove herself from the process siting four individual actions demonstrating bias. It is now being handled by a different judge who has said there will be a hearing. That was some weeks ago. Why am I telling you this story? I have been doing this work for over 16 years and it has always been like this to some degree where most just go through. All the people ask it that the courts work with honesty and integrity all of the time without bias (as most judges do) but not most of them, all of them. We are now serving a section 8 for 14k arrears where this section 21 is perfectly fine and should have been given a possession order in January when the file was opened and this Judge should be sacked. And what of the Judge who has taken over the case? and a matter of integrity? Is he upset that we have accused the previous judge of bias and what is he looking after? The rules or his colleague? We have had other Judges in Croydon who consistently offer incorrect reasons for striking out a claim. We sense a culture in this particular court.

so that we can keep picking up the phone and give anyone who needs it free and expert help it says in the report. I have seen shelter using young people in my local town approaching people for money and it is easy to assume with a name like Shelter that by giving to shelter you are actually helping the homeless. Shelter is a charity which is a vehicle to align a solicitor with a tenant who is being evicted and to find a loophole to (in the short term) protect the tenant from eviction. Is that what people think they are contributing to when they give to shelter. A charity which does exactly the same job as the local solicitor using legal aid and claim costs at court if they win a case except they get the public to assist with there telephone marketing.

Set up to keep people in their present home by fighting the landlord in court. I am not aware that shelter actually houses anyone. Please publish your records.Their legal department was set up by a judge and shelter lobbies unashamedly to shaft the landlords rights in favour of the tenants it seems to me. Show me something shelter have done which helps the overall situation regarding housing. Did retaliatory eviction? In the long run no it just gave the tenant and shelter another reason to delay the inevitable. How can a section 8 for rent arrears not be a retaliatory eviction? Shelter are the lobbyists in favour of removing the section 21. I sense a deeply bigoted bunch who do not live in the real world but have an agenda that attracts huge amount of money as a charity. Which functions to further shaft the landlord for court costs. What did a thousand people a day do in order to find themselves in a position where the landlord had no other choice except to evict them? I am not saying that all tenants are bad, but if there are a thousand a day being made homeless does that show there are a thousand bad landlords to match? And to conclude 'keeping thousands safe in their homes' their homes if they elected to act in a tenant like manner of course. Why does Shelter always assume in the way they present these situations as though butter would not melt in the mouths of the tenant? Is it to substantially increase their coffers by any chance?

For example protecting a deposit after thirty days did not satisfy the rules and proves that the tenant is entitled to make a times three deposit claim. It appears that some fault sits with a conveyancing solicitors none existent understanding of the rules in protecting his client. Whereas if it was common practice to show that the deposit had been returned by the vendor landlord prior to exchange or even better before going to auction as a selling point, to whom could a possible three times claim be directed to? Seek your own legal advice.

If after the first month they don't pay the rent, you have avoided the most secure way of mitigating risk which is to bail and and sell.

This is a very naive view coming from a not so impartial (law society) source it seems. In to politics are they? They should stick to their day job.
