Database of rogue landlords and agents to be introduced in April

It has been confirmed that a database of rogue landlords and letting agents as well as new banning orders will be introduced on April 6, 2018.

The database, which was initially announced last year as part of the Housing and Planning Act 2016 to root out rogue landlords, is expected to come into effect once the regulations have been approved in the New Year.

The database will include information on landlords who have been served with a banning order or have been convicted of a banning order offence, preventing them from letting or managing a property.


The Department of Communities and Local Government (DCLG) has now released details of what offences could lead to a landlord receiving a banning order and being included on the new list.

The main issue are as follows:

+ Illegally evicting or harassing a residential occupier in contravention of the Protection from Eviction Act 1977

+ Using violence to secure entry under the Criminal Law Act 1977

+ Failure to comply with an Improvement Notice

+ Failure to comply with a prohibition order

+ Offences in relation to licensing of Houses in Multiple Occupation;

+ Offences in relation to licensing of houses under Part 3 of Housing Act 2004

+ Contravention of an overcrowding notice

+ Failure to comply with management regulations in respect of HMOs

+ Providing false or misleading information

It is not clear at this stage if the database of rogue landlords and agents will be made public.

    make sure that defaulting tenants are reported to the credit reference agencies and always pursue rents via legal redress

    i have made it my policy to always issue a county court summons for unpaid rent or costs involved in repairing damage, it's easy to do online and not expensive, the tenant gets a ccj, i thing it's worth every penny.

    Demonisation of landlords continues unabated. I can't begin to tell you heartily bloody sick to death of this I am. We fall over backwards to satisfy every requirement, and now this. What the hell is it with this government and tenants?

    Rogue landlords and letting agents do need to be sorted out but why do I get the feeling that this is also being implemented as another veiled threat to good landlords/letting agents ......and why do I suspect it will mostly serve to help tenants strengthen their hand yet further by threatening to make (or actually making) false accusations against their landlord/letting agents - particularly if the tenant has arrears or is in the process of being evicted.

    Why make more regulations for Landlords we now had 10 years of this doing enormous damage driving rents through the roof, making letting un-affordable. Lumbered with huge taxes / Stamp Duty Land tax 3% super levy / Capital gains tax 8% surcharge /Insurance Premium tax hike, Licensing schemes expensive & funded totally by us, penalties up to £30k by local Authority who keep 37% for themselves this is conflict of interest, Investment tax relief cut by 25% per year until it disappears, 10% wear & tear gone which was there as long as letting itself, Section 21 made useless by Deregulation Act, Deposits not worth having they made them another liability.

    What about a dbase for rogue tenants? We have one that never pays until the last minute and promises payments that come....very slowly. Yet we fall over backwards to keep them happy.
