Five figure fine for landlord after tribunal appeal failure

A landlord has been issued with a £16,000 penalty after the Residential Property Tribunal dismissed an appeal and upheld a financial penalty.

North Norfolk council issued the landlord with an Improvement Notice, which escalated to a Financial Penalty after remedial works were not completed within the specified timeframe.

An officer from the council visited the property after tenants raised concerns about living conditions. The inspection confirmed that the accommodation contained hazards including excess cold and electrical disrepair.

Leader of the Council, Tim Adams says: “If you are a private landlord, it is your responsibility to make sure that the property you are letting out is safe for tenants and is in good condition as to not represent a hazard to the health of those tenants.

“I am pleased that the Residential Property Tribunal has upheld the financial penalty notice and that the landlord has been held accountable to their privately rented property.”

    Has anyone checked North Norfolk councils performance in doing repairs in its own social housing? I wouldn’t be surprised if there were far worse cases in their own social housing. The hypocrisy of councils is appalling. No information is provided but who caused the disrepair? I will not be surprised if most of the issues were down to the tenant. The main issue though is why fine the landlord why did the council not help the tenant do the repairs and charge the landlord? To fine the landlord does not solve the problem which is the tenant has a property in disrepair. We talk about giving tenants responsibility when it comes to paying their universal credit to their landlord why not to organise repairs if the landlord fails to do so? This is the model adopted in many American states and it directly addresses the problem. Landlord bashing is not the answer to these problems it is just a way for councils to make money and bullies called housing officers to have power.

    I very much agree with the above statement ….it is exactly what should happen. Again, there are lots of reasons for disrepair and why is it that tenants can get away with trashing property and no financial penalty or accountability - there should be something in law for this too !!

    It’s hardly a forecast more like a foregone conclusion with the market being distorted by Government interference regulations and Schemes, you don’t need a degree to know what affect rising Mortgage interest rates have on buyers.
    God help first time buyers that have been roped into over priced purchases with Schemes when market slows they’ll be left holding the baby while their friends who kept their powder dry may well be buying for £50k less. The housing market as far as Landlords are concerned has been manipulated by playing ducks & drakes with Stamp Duty Land Tax. I certainly wouldn’t buy with that amount of dead money up front (never mind S24, white paper, licensing & S21) how many years to get that money back alone, if you need to sell the next buyer is not going to give your SD but he’ll want his SD knocked your original price which has already fallen. I seen it all before without all those day added incumbents.

    The problem is with any solution to solve repairs with regards to private housing sector, involve the Council it won’t work they’ll be always the obstacle throwing spanner’s into the works while being paid from public purse.

    There was very little damage caused to the property by the Tenants prior to the introduction of new Deposit Scheme in 2007 when they knew if they damaged the property they would loose a chunk of their Deposit. However with the new pretend Deposit Scheme which now only protects the Deposit it self and nothing protecting the property what do you expect. It’s now a liability maybe give them back 3/4 times the Deposit you got, plus Tribunal’s and Ombudsman to back them up, if you take a Deposit now you are only minding it for them and not long before they’ll want you to give them interest on it as well. Bash away don’t worry it’s not your property, don’t tell the landlords until he sees the damage for himself, then tell him it’s been like that for a year but didn’t notify, how many times have I been told that.
