Police and council back landlord’s Section 8 notice on nuisance tenant

Liverpool council and Merseyside Police have secured the eviction of a private tenant making life ‘a nightmare’ for the local community.

The council investigated complaints of anti-social behaviour including drug dealing, noise, intimidation and fouling from dogs left alone at a property in Liverpool.

The council and police backed the landlord, who served a Section 8 notice to evict the nuisance tenant.

The tenant’s behaviour was having a detrimental impact on the local community as she would leave three noisy dogs alone in the flat and go out all day. 

Groups of men believed to be linked to drug dealing and organised crime were also in regular attendance at the property.

A council spokesperson says: “Nightmare neighbours can cause untold misery for local communities.

“Working with partners, we can and will take action to evict those whose behaviour is having a detrimental impact on people who live close by.” 

The landlord of the property, whose identity is being kept confidential, says: “I would like to thank the Council and Merseyside Police for their assistance in this matter. Without their help, I don’t know what I would have done”.

At a Liverpool Magistrates Court hearing the landlord was successfully granted possession of their property. Bailiffs who visited the flat subsequently found the tenant had vacated the property, and had also caused thousands of pounds worth of damage.

    Well that’s a rarity. The council and police backing a landlord to get his property back. But I’ll be keeping my S21 or else. Can’t trust anyone these days.

    This shows how bad the situation will be without section 21 being an option. Any anti-social behaviour should be grounds for eviction. Many landlords will express surprise at the police and a local authority supporting a landlord, this is a rare exception to the norm.
    How have we got to a place where a landlord trying to do the right thing, is regarded as an opponent or as the societal enemy, by publicly funded bodies such as the courts, the police the government and our ridiculous local authorities.
    I expect this foolish bias from pressure groups as it seems as if they are victims of left wing anti-landlord indoctrination, but public bodies should be honest and unbiased.
    As with all of the ongoing attacks on landlords the real losers will be sub-prime tenants.
    I've housed vulnerable and struggling tenants for decades, but not any more. It's just too risky now without a reliable property recovery route.
    With my rents going up rapidly, I've started asking my tenants about their retirement plans as they won't be able to afford private rents on a pension. None have any plan.
    If we think the housing situation is bad now, wait until the indoctrinated fools get their way and the PRS is truly hollowed out, and this generation of renters retire into HMO's that will be truly grim.
    Good luck to them, in trying to get a council house if they don't know some at the council or belong to one of their favoured interest groups.
    The worst thing about this whole debacle, is that in the best spirit of propaganda, even though this mess is not of our making, landlords will be blamed.

    Great post 👍🏻 I to think the renters in retirement are a hidden danger the government have missed 😱 can you imagine being in a shared house in your “ golden years “ 🆘🫣🆘🫣

    Renters are already retiring into HMOs. I have had a retired gentleman renting a room off of me for about 8 years now. He can't get anything else like sheltered accommodation as he's still fit enough to use the stairs, at least for now.

    I have had tenants that needed evicting although not quite as bad but certainly expensive to me and their neighbours. I had to use bailiffs but luckily the tenant vanished instantly. The Bailiffs already knew who he was.
    A big thank you? to my letting agent who firmly believed every one has a right to rent. They are no longer in business.

    I ditched my agent soon after they were no help whatsoever when I had to evict a tenant for rental arrears Have managed myself for a lot of years now and have the same tenants who now have children

    This is why we need S21 - things have to get as bad as this story before Section 8 is effective. But if a tenant is obnoxious and careless in looking after your property - there will be no mechanism to remove them while they consistently trash your property over time.

    Removal of S21 will ensure only gold standard tenants will be offered tenancies because diligent landlords won’t take the risk on anything less. How is that helping renters? The department for levelling up costs has a lot to answer for.

    I don't understand the mentality on here in the slightest. Meet your tenants, talk to them, you will be able to tell after a couple of conversations how someone is. If you get a vibe that you don't like, don't rent to them. Manage things better instead of having other people manage things poorly for you. There is no need for S21 unless you managed things incorrectly and are focusing on money. Due diligence will get you a long way as well as being in contact with your tennants and being less of an authority figure.

    Why not petition for a different section that doesn't allow property damage or something more focused on what problems arise, instead of a blanket section used to uproot tenants whenever a landlord has "had enough".

    You are renting to people who need a home, they will only destroy the property if they have no respect for you as their landlord. I have never had any problems as I manage my tenants effectively, efficiently and importantly I talk to them on a level rather than down to them.

    Most landlords here seem to have no respect for tenants as they don't own their own home, so immediately a lot of landlords are talking and looking down on their tenants. Think about these things when wondering why your tenants have become people you don't want in your property.

    It's 2024 and if you can't do your job properly, you shouldn't be doing it and you will have problems until you get with the programme or stop renting.

    It is blindingly obvious that there are many very good, caring, capable, committed and vastly experienced landlords that contribute to this forum.
    Obviously, no landlord can be successful in this business without cultivating good and respectful relationships with their tenant's. No landlord can be successful in this business without being focussed on money, to do otherwise would guarantee failure. No landlord can for ever escape the possibility of ending up with a bad tenant regardless of how caring, communicative and efficient that landlord maybe. No truly successful landlord wants to serve a sec 21 without very good reason be that personal or as a consequence of some catastrophic failure of the tenancy to which there is no achievable remedy. No landlord having strived hard to build their lettings business is going to support or submit to any actions taken to erode their absolute right to ownership and control of their business. Sec21 is not solely about ‘evictions or faults’, it also ‘defines and upholds the concept of ownership’.

    Why is it you think that ‘ landlords can’t do their job properly’? We currently house at least 9 million people and over 80% of tenants are more than satisfied with us, a higher number than all other forms of rental tenure. The ‘up rooting of tenants via section 21’ in social housing is a magnitude higher than the comparatively low numbers evicted from the PRS. We are ‘with the program’ and have been for years!

    John there are many points you make I do agree with, I most certainly do not look down on my tenants, those that work are my equal, those that scrounge off my tax are scum of the earth, I do use an agent, I also meet my tenants as I carry out my own repairs, I give them my phone number and email, they are free to contact me direct, most have turned out to be friends, first name terms and all that, most people you can talk to but there are always those that you simply cannot talk to

    It sounds like you are doing an excellent job as a landlord to your tennants. Let's always remember, they are real people with real problems and most times by talking to each other and understanding, we can all make sure things get better for all involved.

    S21 is not needed if we do our jobs correctly and don't just leave it to someone else to manage. Remember guys this is a job and most jobs require 8hrs per day or more to get things done properly. You cannot expect to sit back have lots of money and not do a considerable amount of work.

    S21 is for no fault evictions, you are all talking about the Tennant's creating damage etc and you could have a section for those matters. Having no fault evictions does not help anybody, as you have clearly stated it's the problems they create that cause you to want them to vacate the property. So why hang on to no fault evictions unless you use it to do as you please when you would like to which is completely unreasonable.

    Sec 21 is the accerlerated eviction route to get rid of non payers and generally bad tenants quickly, we don't need the no fault part what we do need is a quick way of getting rid of rogue tenants, sec 8 is not fit for purpose

    THE RENTERS REFORM BILL in turmoil says tomorrows Sun imagine that, The Conservative MP’s divided and in uproar, why on earth did they put such a stupid thing in their Manifesto without asking landlords. It says Officials are at a loss given both pro landlord groups like National Residential Landlord Association and Pro Renters groups like Renters Reform Coalition want the Bill passed as soon as possible. I kid you not so we have no voice and betrayed by NRLA who hijacked NLA, the Organisation that we supported is acting directly against out interest its outrageous and totally unacceptable continue on this path and there will be repercussions I for one will do FA.

    I, for one, will not be renewing with the Not Residential Landlords Association. If every landlord opposed to losing S21 etc left, they could rename it Ben's Band of Bruvvers.

    I did see an earlier post (not necessarily on this thread) where some one said they were keeping their NRLA membership long enough to go to AGM in November? I think it was and introduce a vote of no confidence. I am not an NRLA member nor will I ever be but I would love to see a group of members band together and stand up at the AGM and confront Beadle. I wrote to him on his direct email and told him he did not represent us and why and got a reply which I believe I did publish on Landlord Today a few months ago that basically said I was wrong! He does not give a T*ss

    The problem might go away for this landlord but this tenant will just end up somewhere else, maybe with some other poor unsuspecting landlord. This is why I've been calling for a 'TENANT'S REGISTER' rather than a LANDLORD'S REGISTER. There are probably 100 bad tenants to 1 landlord. Problem is: the Gov won't make any money out of tenants!!!!
