Court Delays - landlords set to wait even longer

Landlords are to face even longer waits for eviction court cases following the spending cuts announced in the Autumn Statement, it’s feared.

“The justice system is in crisis and facing systemic failure. Increased funding is vital to keep it functioning” says Nick Emmerson, Vice President of the Law Society of England and Wales.

He continues: “In criminal justice, there are huge backlogs in the courts. Victims’, witnesses’ and defendants’ lives are in limbo as they wait years for justice, with cases listed as far ahead as 2024.

“Courts are crumbling, dogged by delays, and there are chronic shortages of judges and lawyers as professionals leave this underpaid work in their droves. Duty schemes are failing, leaving the right to representation at police stations in peril.

“Recruiting more police and talking tough on crime will matter little if the courts can’t deal with the volume of cases already going through the system, let alone many more. Criminals may instead be emboldened.”

And he adds that in civil justice, there are vast legal aid deserts across England and Wales, meaning people who are entitled to legal aid can’t access it.

“The cost-of-living crisis and public spending cuts mean more and more people will need legal help with life-changing issues such as homelessness and debt. But who is going to give that vital advice if there aren’t enough solicitors to meet the current demand?”

He concludes that the government will be forced to pick up the pieces, at greater cost, further down the line. In the meantime he warns there will be the risk of there being a justice system “in crisis”.

    This appears to be aimed at criminal courts?? The same issue may affect the civil side…. And if so that makes the lose of s21 even more worrying.

    s21 needs to be retained for fair laws to enable good landlords & help to keep people in safe homes in PRS.

    Someone said "Justice delayed is justice denied".

    Time we gave huge incentives to people who plead guilty or settle out of court and huge disincentives to those criminals who plead Not Guilty and those clients of Shelter etc. who play the system, causing misery to decent people and the real victims!

    Simon, further to changes in the law in recent years landlords issues are now a matter of Criminal proceedings so as I understand it, it’s criminal law for landlords and Civic law for Tenants are we not all equal before the law ?.

    A Landlord Association should begin a Class Action by Landlords for losses from Covid Restrictions and slow Courts. Edmonton County court took 8 weeks to confirm their decision to let Tenants post a weak counterclaim and still have not acted when there wasn't one.
    20k arrears since Covid started, a year of free living and still no home back (4 months, 2 hearings, once cancelled on the morning when the roof leaked!).
    Do JUDGES HATE EVEN ACCIDENTAL LANDLORDS??!!

    (never become a Landlord... especially with the furture changes, made to hurt us even more!)

    (Agree with Andrews comment, should have sold up before it came pretty much impossible to get a tenant working for a substantial employer (75% pretended to be self employed for credits), however if GOVT help any tenant stay half a year or more, without eviction, no landlord is safe!)

    Mark it's very much a case of being careful when selecting a new tenant, an empty property is better than one with a bum tenant in it

    Saville’s, held their November Auction raising £28m.
    Then held another November Auction which they didn’t hold before so many landlords were eager to get out because of the constant unjustified attack by Government & location Authorities, therefore Savill’s raised a further £32m = £60m
    a record, any penny dropping yet.
    Make no mistake this is for the Big New fat Boys to take over our Business, when were they even involved in lettings then people talk about inexperienced and accidental
    landlords how could they be less experienced than the
    new people taken over that never done it.

    Obviously you all know by now who the Big New fat Boys are, just in case let my refresh your memories.
    John Lewis Building 10 thousand Flats mostly over Waitrose’s which they own, in Ealing, Bromley and Reading with the intention of increasing that number to 50k Flats. Mark’s & Spencer’s Hammersmith 10 storey Block, Barclay to convert Banks to Flats and have a £1 billion fund for new homes, Avivia Insurance to move out 900 Office Staff to convert the Office’s to Flats, Lloyds’s Bank converting Banks to Flats
    (I think they own Halifax).
    Legal and General £2,billion Pension Fund for Housing & they call it levelling up, some bad joke. Go on then try and convince me this is nothing to do with the constant sustained attack on Private Landlords to get us out of the way for them to take over, pull the other one it’s got bells on.

    I came at the back of Housing Act 1988, and I leave the industry if S21 is repealed. Without S21 you will lose the control of your asset. In other words, you are at the mercy of the tenant. Once the economic situation deteriorates further, as it will be according to the BoE boss, then the tenants will be left with a choice of, heating, feeding or rent paying. Some of us are already experiencing this. A decent tenant will either hand over the keys or go into some sort of negotiations with landlord with regards to the rent. There will be some tenants who will take advantage of the abolishment of S21, and enjoy occupancy rent free. For these reasons, I am out.

    Section 21 will encourage people not to pay. Furlough, 85 pecent of wages. Working people don't get 85 percent when taxed.! Some were better off. Benefit claiments got an extra £20. Still not pay rent.
    It's a sense of entitlement. Rob from perceived rich ....the landlord.

    The loose of sec21 means the inability of many tenants to find a home, if a prospective tenant isn't working, isn't earning at least 3x the rent, has a poor credit history, and cannot provide a suitable guarantor then it's off to the camping shop to buy a tent, we are better off with empty properties than one with a tenant in that either cannot, or will not pay the rent
