Landlord illegally evicted tenant and lands up in court

A landlord has been ordered to pay £5,312 for unlawfully evicting his tenant of 18 months.

In April this year Bassetlaw council was approached by an individual twho had been wrongfully evicted from their private-rented home in Worksop, by their landlord - Sunjeet Dubb of Lincoln.

Dubb attempted to pressure his tenant into ending their tenancy a month earlier and changed the locks to the property, leaving his tenant with nowhere to stay and without access to their belongings, including medication. Dubb refused to change the locks back or provide the tenant with keys when requested by the tenant and council officers.

In April, Dubb attended the council for an interview under caution. He failed to follow the correct legal process to evict his tenant, and broke the law by changing the locks on the property without giving his tenant notice and obtaining a possession order through the Courts. 

Dubb attended Mansfield Magistrates Court recently to plead guilty to the offence. 

The court sentenced Dubb to pay a £233 fine, £89 victim surcharge, £668 contribution to costs and £4,322 B&B charge to repay the council the cost of the accommodation which had been provided.

A council spokesperson says: “It is vital that landlords are aware of their responsibilities and act in accordance with any relevant laws. In this case, Mr Dubb’s unlawful conduct deprived his tenant of his belongings, resulting in them having to buy additional clothing, being unable to access their medication or acquire more, and requiring accommodation from the xouncil.

“The council contacted Mr Dubb in an attempt to rectify the issue before it progressed, but to no avail. Had Mr Dubb followed the correct process, the tenant would have had much more time to find alternative accommodation and may not have become homeless.”

    One sided again. Not even a snippet of why the Landlord took such drastic action. Reads as if another saintly individual has been removed for no reason, when in reality the place is probably trashed and huge arrears of rent no doubt.

    Jumping the gun are you well my previous landlord tried to evict me illegally along with two others and all the rent was paid and he and his wife are going to court.

    Correct Adrian, reading that report it seems something has gone wrong and not necessarily the landlord.

    I have an example and two viewpoints on this and whoever agrees or disagrees is fine with me

    I am going through drama with a flat where the tenants have trashed it and refuse to move out, the council have issued an improvement notice to repair the damage they have caused, they have upset other tenants and on occasions not paid rent. I am now going through court to get them out. They arrived in the flat via someone subletting it to them so some paperwork is not lined up.

    1. This seems like a fairly cheap eviction for the landlord if he has been wronged and needed them out.

    2. If the tenants have been unfairly kicked out a month early how on earth do the council manage to rack up over 4k in B&B costs??? This needs to be looked at.

    Bet the B&B is run by a mate of a mate in the council like the Birmingham taxi fiasco.

    I agree ive been asked to go many times, its because I dont pay my rent, trash the place, sub let, grow illegal drugs, run a brothel, and spend all my rent on the latest iphone , holidays and avocado toast

    Tenants who fail to pay rent or look after a landlord's property or are vexatious and troublesome don't deserve proper treatment and local authorities,Shelter and "woke " media need to understand the problem they are creating.
    This country is 16 million houses short of what it needs and each year the situation gets worse as population growth of 1 million a year is not matched by new housing starts of 150,000.
    Our official population is 68.5 million with 12 million illegal immigrants on top as evidenced by undocumented school admissions and food sold in supermarkets exceeding what the official population could possibly consume.
    Our politicians ignore the figures at their peril as does Big Business.
    Landlords will sell up and I predict 3 to 4 million homeless people ravaged by hunger and disease .
    The current figure is 1.5 million.
    Nett migration needs to be stopped Victor Orban style and the economy needs to be put onto a war footing for export growth whilst systems building needs to be employed to build hostels ,ideally underground for benefit recipients,homeless people and genuine refugees.
    The long term unemployed should be assigned work on farms and in care settings where the farmers would provide caravans and prefabs on their land .
    Benefits would continue with a small top up in exchange for honest work 6 days a week.
    Those benefit recipients of a more emollient disposition would be medically examined and psychologically assessed and placed in care roles.
    Used ,converted shipping containers would be used to house them on industrial estates and brownfield land.
    The indigenous population would be pressed into this workfare scheme in exchange for benefits.
    Landlords would rent only to the creditworthy.

    No doubt the landlord had good reason to take such actions but of course that wouldnt get a mention. I've been trying to get one of my properties back so that I can sell it since last year and it's been knocked back 3 times by the first tier tribunal mob in Glasgow. No wonder landlords are selling up fast in Scotland... and because of my experience I'll be selling the rest as soon as I can.. Sorry, and good luck to my ex tenants in finding
    alternative affordable accommodation. Not my concern any more.

    I am in the process of evicting a tenant who has now not paid rent for 12 months. Followed the legal process but not there yet after nearly 12 months and approx £13k out of pocket up to now. If the illegal route has only cost this landlord £5312 it makes you question?

    Scary stories.
    I’ve been agonising for months how to tell my lovely tenants that they should be looking to buy a house ( there are such cheap options available at the moment) or move out if this RRB indeed gets approved.
    They are paying monthly less than my daily wages after the tax.Same rent for 14 years.
    I really don’t want them to leave until I retire in few years but the fear of not being able to get my house back is keeping me awake at night.
    As an accidental landlord with a full time job it’s never been about the profit.
    many of my friends are in the same position, unable to sell their first house due to sentimental reasons once moving to a different place for work purposes.
    Well I will pay the tenants 3 months rent to bribe them but I doubt it would cover the deposit for another rented house.
    They are young , both employed and just had a baby.
    Definitely should be buying a house. Current rents are insane.
    These politicians are harming so many people- it’s actually criminal.
    Whoever wants to be ?land?lord for profit could only blame themselves when they end up unable to get their house (lifesaving) back . It’s
    not worth it financially or mentally.

    Beverley Smith, your not the only one. I have a carbon copy situated with Tenants swapping without telling you. The lead Tenant subletting then moved out and insisted for months that he was still there (of Course not living with his Partner and child in an other Town in a Flat covered by the Benefit system) until I proved he wasn’t, what money was paid was paid by him directly to Bank but a short fall over £6’000. even though the house is £1’000. pm below market value, nice little earner and the cheek to try on storey’s from Shelter’s website.
    Another property the dog problem although I didn’t want them to have it, its a problem for me, for gas engineer, electrician and today EPC man, re-scheduling visits around a dog, the do gooders can’t keep their noses out.

    Why only mention the Landlord's name and not the Tenant's? If in the future Registration is required (which I personally feel is a massive mistake) then there should be a Register for both Landlords and Tenants.
